Mobile App – Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

This Terms of Service is in addition to Apple’s Standard EULA, which applies to your licence of the iOS App.

2. Eligibility & Accounts

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the App. When creating an account, you agree to provide accurate information and keep it current. You are responsible for safeguarding login credentials.

3. Licence Grant

Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable licence to install and use one copy of the App on a device you own or control solely for personal, non‑commercial purposes.

4. Subscriptions & In‑App Purchases

• • Billing. Digital goods, including subscriptions, are billed by Apple App Store or Google Play.
• • Auto‑Renewal. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• • Cancellation. Manage or cancel via your platform account settings.
• • Refunds. Subject to platform policies and applicable law.
• • Trial Offers. If you do not cancel before trial ends, you will be charged the subscription fee.

5. User‑Generated Content

You may submit content ("UGC"). You retain ownership but grant us a worldwide, royalty‑free licence to use, reproduce, modify, and display UGC to operate and improve the App. You are solely responsible for UGC and must have the necessary rights.

6. AI & Automated Features

If the App offers AI‑powered functionalities:

• • Output may be fictional, inaccurate, or offensive; use at your own risk.
• • Do not rely on AI output for professional advice.
• • You must not provide inputs that infringe others' rights or violate law.
• • We and our AI providers disclaim all liability for AI output.

7. Prohibited Conduct

You agree not to:

1. 1. Violate any applicable law or regulation.
2. 2. Reverse engineer, decompile, or attempt to derive source code except as permitted by law.
3. 3. Interfere with or disrupt servers or networks.
4. 4. Upload malicious code or content.
5. 5. Use the App for harassment, hate, or disinformation.
6. 6. Circumvent subscription or DRM mechanisms.

8. Intellectual Property

The App and all content (excluding UGC) are owned by YAY! Studios Ltd or its licensors and protected by law. All trademarks are property of their respective owners.

9. Third‑Party Services & Links

The App may incorporate third‑party SDKs or link to external sites. We are not responsible for third‑party content, policies, or practices.

10. Disclaimers

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not warrant that the App will be uninterrupted, error‑free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, YAY! Studios Ltd shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to the App.

12. Indemnity

You agree to defend and indemnify YAY! Studios Ltd from any claims or damages arising out of your breach of these Terms or misuse of the App.

13. Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms. Upon termination, rights granted herein cease and you must delete the App.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of England and Wales without regard to conflict‑of‑laws principles. Any disputes shall be resolved in the courts located in England, unless mandatory local consumer law provides otherwise. We may opt for binding arbitration where permitted.

15. Changes to Terms

We may modify these Terms at any time. We will post the updated Terms and indicate the "Last Updated" date. Continued use after changes constitutes acceptance.
